TERMS AND CONDITIONS OF LOVINGLY MADE ONLINE STORE

§1 General Provisions

  1. The online store available at lovinglymadeshop.com is operated by Anita Wójcik, conducting business under the name Lovingly Made, Tax ID (NIP): 6612226885, with registered address at ul. Michała Kleofasa Ogińskiego 2, 27-400 Ostrowiec Świętokrzyski, Poland.

  3. These Terms and Conditions govern the rules for using the Store, placing orders, making payments, delivery, and Customers' rights, including the right to withdraw from a contract and to submit complaints.
  4. Using the Store constitutes acceptance of these Terms and Conditions.

§2 Definitions

  • Seller – Anita Wójcik, NIP: 6612226885, ul. Michała Kleofasa Ogińskiego 2, 27-400 Ostrowiec Świętokrzyski, Poland.
  • Customer – a natural person, legal entity, or organisational unit without legal personality, making purchases in the Store.
  • Consumer – a Customer who is a natural person making a purchase unrelated directly to their business or professional activity.
  • Store – the online store operated at lovinglymadeshop.com.
  • Order – a declaration of intent by the Customer aimed at concluding a sales contract.
  • Sales Contract – a contract concluded between the Seller and the Customer via the Store.

§3 Placing Orders

  1. Orders may be placed 24 hours a day, 7 days a week, via the Store's website.
  2. A condition for placing an order is reading and accepting these Terms and Conditions by ticking the appropriate checkbox during the checkout process.
  3. After placing an order, the Customer receives a confirmation to the provided e-mail address.
  4. The sales contract is concluded upon the Seller's confirmation of order acceptance.

§4 Payment Methods and Payment Operator

  1. The Store accepts the following payment methods:
    • Credit/debit card (Visa, Mastercard)
    • BLIK
    • Przelewy24 (bank transfer, online payment)
    • Other methods available via Shopify Payments
  2. The payment operator for Przelewy24 is PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP: 7792369887, registered in the register of national payment institutions maintained by the Polish Financial Supervision Authority (KNF) under number IP24/2014.
  3. Payment should be made immediately after placing the order. In the event of non-payment within 3 business days, the order may be cancelled.

§5 Delivery

  1. Delivery is available within Poland and selected European Union countries.
  2. Order processing time is 1 to 5 business days from the moment payment is confirmed, unless otherwise stated in the product description.
  3. Delivery costs are displayed during the checkout process.
  4. The Seller is not liable for delays caused by the carrier.

§6 Right of Withdrawal

  1. A Consumer has the right to withdraw from a distance contract without giving any reason within 14 days of receiving the goods, in accordance with the Polish Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827, as amended).
  2. To exercise the right of withdrawal, the Consumer should notify the Seller by e-mail at anita1888@o2.pl or in writing to: ul. Michała Kleofasa Ogińskiego 2, 27-400 Ostrowiec Świętokrzyski, Poland.
  3. The returned goods must be sent to: ul. Michała Kleofasa Ogińskiego 2, 27-400 Ostrowiec Świętokrzyski, Poland within 14 days of submitting the withdrawal statement.
  4. The cost of returning the goods is borne by the Consumer, unless the Seller decides otherwise.
  5. The Seller will refund all payments made by the Consumer, including delivery costs (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard option offered by the Seller), without undue delay and no later than 14 days from receipt of the withdrawal statement.
  6. The right of withdrawal does not apply to goods manufactured to the Consumer's specifications or clearly personalised.

§7 Complaints

  1. The Seller is liable for product defects under the rules set out in the Polish Civil Code (statutory warranty).
  2. Complaints should be submitted by e-mail to anita1888@o2.pl or in writing to: ul. Michała Kleofasa Ogińskiego 2, 27-400 Ostrowiec Świętokrzyski, Poland.
  3. A complaint should include: the Customer's name and surname, order number, description of the defect, and the Customer's request.
  4. The Seller will process the complaint within 14 days of receipt and notify the Customer of the outcome by e-mail.
  5. If the complaint is upheld, the Seller will replace the defective goods, repair them, or issue a refund, in accordance with the Customer's request.

§10 Final Provisions

  1. Matters not regulated by these Terms and Conditions are governed by Polish law, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights.
  2. The Seller reserves the right to amend these Terms and Conditions. Amendments take effect upon publication on the Store's website.
  3. Any disputes arising from contracts concluded via the Store shall be resolved by the court having jurisdiction over the Seller's registered address, subject to provisions applicable to Consumers.
  4. Consumers may use out-of-court complaint and redress mechanisms, including via the ODR platform: http://ec.europa.eu/consumers/odr/
